Conditions
**1. Definitions**
For the purpose of this permit, “authorized representative” means the Authority employee authorized to execute a dangerous permits;
“Authority” means the Belledune Port Authority;
“Carrier” means:
a) the name of the vessel loading, unloading or having on board dangerous goods,
b) in the case of the movement of dangerous goods by land, including their loading or retention on or unloading from railway cars or other land vehicles, the railway or land vehicle company, or
c) where goods are to be stored in transit, the name of the terminal operator within the harbour;
“Classification” means the class and division into which dangerous goods fall as provided in the IMDG Code or, upon their enactment, the provisions of the Transportation of dangerous Goods Regulations, and includes:
a) the compatibility group in the cases of Class 1 goods, and
b) any secondary classifications;
“Dangerous goods” includes dangerous goods and explosives as defined in the Port Authority Operations Regulations;
“Location” means the berth, anchorage or other authorized place within the harbour where dangerous goods are to be loaded or retained on or unloaded from the carrier or stored in transit in care of the terminal operator;
“Permittee” means the applicant under Part I of this Permit;
“P.1.N.” of “Product Identification Number” means:
a) the U.N. Number as provided in the IMDG Code, or
b) upon enactment of the Transportation of Dangerous Goods Regulations, the Product lndentification Number as prescribed by those regulations, and
“Shipping name” means with respect to dangerous goods, the technical name as referred to in the IMDG Code or upon enactment of the Transportation of Dangerous Goods Regulations the name prescribed by those Regulations

**2. Liability**
a) no claim or demand of any nature whatsoever shall be made against the Authority by the permittee arising out of an accident resulting in the death of or injury to any person, or the loss of, damage to, or destruction of property, unless the accident was caused by the sole negligence of an Authority employee within the scope of his duties or employment.
b) every permittee shall indemnify and save harmless the Authority in respect of any claim or demand of any nature arising out of an accident resulting in the death of or injury to any person, or the loss of, damage to, or destruction of property, unless the accident was caused by the sole negligence of an Authority employee acting within the scope of his duties or employment.
